DIVISION 1.  GENERALLY

Sec. 78-321. Damaging, Removing, etc., City Property.

The intentional destruction, damage, defacement or removal of city property within the 172-foot contour line on Cross Lake is

prohibited. Any person convicted of violating this section shall be punished in accordance with the general penalty provision, section

1-14 (Shreveport City Code), or by revocation or cancellation of any previously granted privileges relative to the use of Cross Lake;

or by both such punishment and revocation or cancellation.

Sec. 78-322. Littering or Dumping Prohibited; Penalty.

(a) No person shall intentionally dump, leave or deposit any glass or metallic object, trash, refuse, garbage or discarded object,

including but not limited to tires, on or in the waters of Cross Lake or any lands, whether public or private, located within the 172-

foot contour line.

(b) Any person convicted of violating the provisions of this section shall be punished by a fine not to exceed $500.00 or

imprisonment for not more than ten days, or both. In lieu of imprisonment, such person may be required to perform up to four

eight-hour days picking up trash or refuse, or performing other court-approved community service activities.

Sec. 78-323. Abandoned Personal Property.

(a) Abandonment of personal property, such as trailers, boats and the like, on the land or water areas of the Cross Lake Reservoir

is prohibited. Personal property shall not be left unattended, except in accordance with permits issued therefor.

(b) No responsibility whatsoever will be assumed by Cross Lake authorities for any personal property left abandoned or unattended.

Sec. 78-324. Sale of Alcoholic Beverages.

It shall be unlawful for any person to sell any alcoholic beverage, as defined in section 10-1 (Shreveport City Code), on the

properties of Cross Lake within the 172-foot contour line, mean gulf level, except when operating under a contract with the city which

specifically permits such sales. When so authorized, such person shall comply with all other applicable laws and ordinances,

including but not limited to Chapter 10 and Chapter 106 (Shreveport City Code).

Sec.  78-325. Taking of Frogs.

(a) It shall be unlawful to take frogs within the 172-foot contour line and below, except in accordance with subsection (b) of this

section.

(b) Bullfrogs and lagoon frogs may not be taken during the months of April and May. Frogs may be taken in open season with the

aid of a jacklight or any other visible light and by means of mechanical devices known as frog gigs.  No person shall carry or

have in his possession any shotgun, rifle or firearm while taking or hunting frogs during the nighttime. A person may take any

species of small frogs known variously as greenfrogs, grassfrogs, leopardfrogs, springfrogs, etc., for scientific, educational or

propagating purposes, regardless of size, but not for food or sale. Selling of bullfrogs and lagoon frogs is permissible during any

part of the year.

(c) The taking of frogs shall not be permitted, however, where it conflicts with the exclusive right to the use of property within the

172-foot contour line granted to the abutting property owners by section 78-356.

Sec. 78-326. Camping.

All persons are hereby prohibited from camping on the shores of Cross Lake or within the area of the contour line of the property

belonging to the city, except in specified areas where proper sanitation facilities are available.

Sec. 78-327. Aircraft Regulations.

(a) It shall be unlawful for any person to fly any aircraft, seaplane, glider or any other type of aircraft less than 500 feet above the

waters of Cross Lake, or to bring such craft to land on or take off from the waters of Cross Lake, except as follows:

(1) In cases of emergency.

(2) Any person operating pursuant to a contract with the city which specifically permits such flying or landing. Any person so

permitted to fly or land shall do so only in areas of the lake designated under the contract for that purpose. Such person

shall notify the Cross Lake Patrol in advance of any such flying or landing.

(b) No permanent or base facilities for aircraft shall be permitted within the 172-foot contour line of Cross Lake unless permitted

pursuant to a contract with the city.

Sec. 78-328. Complaint Procedure.

Any person aggrieved by any rule or regulation set forth in this article, or promulgated pursuant to legal authority granted in this

article, may file a written complaint with the chief administrative officer or his designee. Upon receipt of such complaint, the chief

administrative officer or his designee shall have ten working days in which to resolve the complaint. If he is unable to do so or if the

proposed solution is not satisfactory to all parties concerned, the chief administrative officer or his designee shall bring the complaint

before the city council at its next regularly scheduled meeting. At a time and place to be set by the council, the chief administrative

officer and the complainant shall be given an opportunity to be heard on the matter, after which the council shall reach a decision,

which shall be binding upon all parties, subject to their right to judicial appeal.

Sec. 78-329. Penalty for Violations of Article.

Any person convicted of violating any provision of this article, for which a specific penalty is not provided, shall be punished in

accordance with section 1-14 (Shreveport City Code).

Sec. 78-330. Execution of Applications.

The mayor is hereby authorized to execute applications on behalf of the city as owner of Cross lake for special exception uses and

metropolitan planning commission approvals for the use of Cross Lake. Provided, the execution of the applications shall be

construed only as permission for the applicant to proceed with requesting the approval from the zoning board of appeals or the

metropolitan planning commission. The execution of the applications shall not be construed as granting approval of the use or as

indicating that the appropriate board or the city council will grant approval of the use or that the city will enter into a contract with the

applicant for the use of Cross Lake.

Sec. 78-331. Cross Lake Public Boat Ramp.

Public access to the Cross Lake public boat ramp shall be restricted to any person between the hours of 1:00 a.m. and daylight (30

minutes before sunrise).

Sec. 78-332. No Wake Areas.

All canals and bayous posted by “No Wake” signs shall be enforced by the issuance of citations and by prosecution in the city court.

DIVISION 2.  CONSERVATION, SANITATION AND POLLUTION CONTROL

Sec. 78-341. General Powers and Duties of the Department of Water and Sewerage.

The Department of Water and Sewerage of the city shall be the department of city government responsible for the enforcement of

all valid federal, state and local laws or ordinances, rules and regulations regarding sanitation and pollution control on the bed and

waters of Cross Lake and for a distance of 5,000 feet from the meander contour line which extends to the 172-foot mean gulf level

line, as well as over the stream and tributaries of such lake for the same distances. The department shall have supervision of all

matters pertaining to the sanitary conditions necessary to prohibit all nuisances within, as well as outside, the limits of the city that

would in any manner tend to pollute or contaminate the water embodied within the bed of Cross Lake water reservoir established by

the city or to pollute any streams, drains or tributaries thereto, which constitute the source of water supply of the city, as well as

provide for the protection of any watersheds thereto, and such other supervision as may be necessary to prohibit and prevent the

pollution of the water in Cross Lake, its streams, drains and tributaries, both within the corporate limits of the city and beyond the

corporate limits, as well as to provide for the protection of the watersheds of Cross Lake and to supervise, regulate and control the

sanitary condition of and to prevent the commission of nuisances in, around and upon such lake and the watersheds thereof, and the

streams, drains and tributaries thereto, in, around and upon the premises occupied by any buildings, dwellings, barns, outhouses,

camps and campsites that might be situated on the shores of Cross Lake. Among other things, the Department of Water and

Sewerage shall prohibit and prevent nuisances of any kind in or upon Cross Lake, its drains, streams, tributaries and watersheds,

and prescribe regulations framed to prevent the spread of infectious and communicable or contagious diseases affecting the public

health, and maintain proper sanitary conditions on, in and around Cross Lake, its drains, streams, tributaries and watersheds, and in

and upon any premises located on such watersheds, and upon premises occupied by any buildings, dwellings, barns, outhouses,

camps or campsites located within the limits of the city or outside the city that may endanger the public health by pollution or

contamination of the water supply of Cross Lake. The Department of Water and Sewerage shall have the power to prescribe such

rules and regulations as may be necessary to preserve and maintain the Cross Lake area, including its drains, streams, tributaries

and watersheds, in sanitary condition.

Sec. 78-342. Authority to Issue Permits on City Property.

The subdepartment of Permits and Inspection shall be authorized to issue permits for the construction and/or placement of all

improvements and developments on city-owned property on Cross Lake within and below the 172-foot contour line after the

subdepartment of Permits and Inspection, the Department of Water and Sewerage, and other applicable departments, have

reviewed the plans for the proposed improvement and/or development and have approved such plans in writing.

Sec. 78-343. Area Where Public Use Prohibited.

(a) Public use of any nature in the area located on and within 300 feet of the spillway of Cross Lake is hereby prohibited.

(b) Public use of any nature in any area within 100 feet of any raw water intake for water purification and treatment plants is hereby

prohibited.

(c) The mayor of the city may establish by executive order such other rules and regulations restricting the use of Cross Lake as he

may find reasonably necessary.

(d) Any areas restricted under these provisions shall be appropriately marked with floating buoys or signs.

DIVISION 3.  BUILDING AND IMPROVEMENTS

Sec. 78-356. General Rights of Adjacent Property Owners.

The property owners adjacent to Cross Lake shall have the exclusive right to the use of the area which abuts their property and lies

between the 172-foot contour line and the water level of Cross Lake, provided that all rules and regulations, restrictions and

reservations, including waiver of any claims against the city for injuries or damages, are agreed to by such property owners.

Sec. 78-357. Permit for Piers, Boathouses, Docks and Other Improvements and Developments.

(a) Piers, boathouses and docks for the exclusive use of their owners, or such other persons as have the consent of such owners,

will be authorized within the 172-foot contour line of Cross Lake only by a permit issued by the city. Such permits shall be

subject to the limitations set forth in this article.

(b) Applications for the permits referred to in subsection (a) of this section shall be made on forms obtainable at the Permits and

Inspections office or the office of the Cross Lake Patrol.

(c) Application for a permit under this section must be accompanied by a sketch showing the location, dimension and construction

plans for any proposed improvement or development.

(d) After inspection of the property and review of the plans contained in the application by the subdepartment of Permits and

Inspections, by the Director of Water and Sewerage, and other applicable departments, and their written approval of same, the

permit required by this section will be issued.

(e) Any pier, boathouse, dock or other improvement or development built without a permit therefor shall be subject to demolition by

the city; provided, however, that the owner thereof has been given the opportunity to remove the improvement himself. The

actual cost to the city of such demolition, including reasonable and required administrative charges, whether performed by the

city or private contractor, shall be charged to the owner, which payment shall be due and payable on the date of completion of

such work. If this cost or expense is not paid within ten days, the director of finance shall furnish the owner, as shown on the last

assessment roll of the city, by certified mail, return receipt requested, a written statement showing the cost or expense incurred

for the work and the property on which the work was performed. If such statement is not paid within one month thereafter, the

amount thereof shall be included in and form part of the taxes due by the owner on such property.

(f) The improvements and developments permitted under this section shall be constructed and/or installed strictly in accordance

with the sketch attached to the permit application. Failure to so construct or install shall be grounds for revocation of the permit

and demolition of the structure.

Sec. 78-358. Maintenance of Piers, Boathouses, Docks and Other Improvements and Developments.

Piers, boathouses, docks and all other improvements and developments permitted pursuant to section 78-357 shall be maintained in

accordance with the provisions of Shreveport City Code, Chapter 19 , and the Property Standards Code of the City of Shreveport.

Violations of such code shall be prosecuted and punished under the provisions of the Property Standards Code.

Sec. 78-359. Maximum Length of Piers, Wharves, etc.

Stationary or floating piers, wharves and other facilities extending into the Cross Lake Reservoir shall be limited to a maximum total

length of not more than 300 feet from the 172-foot contour line. The city shall prescribe appropriate regulations regarding the

construction of piers, wharves, boathouses, etc., so as to minimize, to the extent possible, the obstruction of passage and view of

adjoining riparian property owners.

Sec. 78-360. Mooring of Floating Piers, Docks, etc.

All floating piers, docks, boathouses, barges and other facilities on the waters of Cross Lake must be securely moored in an

approved manner at all times and anchored properly, in order to prevent them from floating away during periods of high or rough

water.

Sec. 78-361. General Powers and Duties of Cross Lake Superintendent.

The Cross Lake Superintendent shall be commissioned by the Chief of Police and shall be under the supervision of the Police

Department. The Cross Lake Superintendent shall have full police authority in enforcing the provisions of all valid laws, rules, orders

and regulations made by competent authority, and particularly the provisions of this article. He shall be empowered to go upon the

private premises within the city and within the area of the Cross Lake 172-foot contour line, and within the area of Cross Lake, its

streams, drains and tributaries and watersheds thereto, and the lands surrounding Cross Lake up to 5,000 feet, and all public

places, to make such inspections, examinations or investigations as he may deem advisable for the purpose of discharging his

duties, and shall have the same power and authority as is granted to peace officers by state statute and city ordinances, including

but not limited to that power and authority granted by articles 204, 211, and 213 of the Louisiana Code of Criminal Procedure;

provided, however, except when in close pursuit, the jurisdiction of the Cross Lake Superintendent shall not extend beyond the limits

stated in this section. As such officer, invested with police authority as stated in this section, he is empowered to summarily abate

nuisances and to enforce and carry out each and all of the provisions of this article.

DIVISION 4.   HUNTING

Sec. 78-371. Generally.

(a) Hunting on the waters of Cross Lake or within the 172-foot contour line is permitted from 30 minutes before sunrise until 2:00

p.m., and in accordance with federal and state laws. Hunters shall be off the lake surface by 3:00 p.m.

(b) Any person under the age of 15 years is prohibited from hunting on the waters of Cross Lake unless accompanied by a

responsible adult.

(c) Notwithstanding any other law or ordinance to the contrary, the discharge of shotguns only will be permitted on Cross Lake.

(d) Rifles, pistols and explosives of any kind are prohibited on the water surface of Cross Lake, except when in the possession of a

law enforcement officer or lake employee on official business. Shotguns are prohibited on the water surface of Cross Lake

except in connection with hunting activities.

Sec. 78-372. Duck Blinds.

(a) Permit and other requirements. Duck blinds will be allowed on Cross Lake by permit only and shall be allowed in specifically

designated areas. Such duck blinds shall be located 600 feet or more apart, and 1,000 feet from the 172-foot contour line or

any inhabited dwelling. Only one location shall be allowed per person. No permit shall be given for the location, building or

placing of blinds, except for the use of the applicant and his bona fide guests.

(b) Application and permit fee. Application shall be made to and approved by the Shreveport Police Department Marine Patrol

Division for a permit to locate, build, or place a duck blind in or on the waters of Cross Lake or any property within the 172-foot

contour line. All applications for a permit to build or locate a blind shall be accompanied by an annual permit fee of $20.00 and a

location certified by the Shreveport Police Department Marine Patrol Division. Any applicant whose location has been certified by

the Marine Patrol Division shall certify in writing that any duck blind at an approved location shall be removed at his cost when

abandoned.

(c) Abandoned blinds. A duck blind will be considered abandoned if it is not repermitted, with the payment of the additional annual

renewal fee, willowed and identified by a permit number and the owner’s name, within ten days after the opening of the

migratory waterfowl hunting season. Abandoned duck blinds or blinds not identified by permit shall be removed from Cross Lake

by the city and/or destroyed as soon as possible 30 days after the opening of migratory waterfowl hunting season.

(d) Restrictions on new blinds. No new duck blind, other than an approved floating type, will be permitted in the main body of Cross

Lake from a point east of the range line, designated as Range 15 West, running across Cross Lake. These blinds shall be

removed from Cross Lake within 30 days after the close of the duck hunting season. All new duck blinds west of the range line

designated as Range 15 West shall be the approved floating duck blind type; provided, however, these blinds may be left on

Cross Lake permanently.

(e) Hunting from approved duck blinds only. It shall be unlawful to hunt ducks on Cross Lake except from an approved duck blind

for which a valid permit has been issued.

Sec. 78-373. Game Reserve; Limits and Boundaries; Hunting Prohibited; Supervision Enforcement.

(a) The City of Shreveport, availing itself of the provisions of Section 4 of Act 31 of 1910 and Act 213 of 1906 of the state legislature,

shall be granted the powers set forth in such acts, and does hereby provide for an area to be known as Cross Lake game

reserve, such area being described on exhibit A attached to ordinance number 232 of 1981, which is on file in the office of the

clerk of the council and made a part of this article (Map on page 9).

(b) Any and all types of hunting, particularly all types of duck hunting, are hereby prohibited in the area described in exhibit A

attached to ordinance number 232 of 1981, which is on file in the office of the clerk of the council, at all times (Map on page 9).

(c) The Cross Lake Superintendent is hereby authorized to properly post such area with “No Hunting” signs to notify the public that

no hunting shall be done within such area. In order to enforce the provisions of this section, he shall have full authority to make

or cause to be made the arrest of any person violating any of the provisions of this section.

Sec. 78-374. Penalty for Violation of Division.

Any person who shall violate any of the hunting provisions in this division shall, upon conviction, be mandatorily fined not less than

$25.00 nor more than $75.00, or be imprisoned not more than 30 days, or both, for the first offense; and fined not less than $100.00

nor more than $200.00, or be imprisoned for not more than 60 days, or both, for the second offense; and for the third offense, the

fine shall be not less than $200.00 nor more than $500.00, and imprisonment for not less than 30 days nor more than 60 days. The

jail sentence provided in this section shall be mandatory, except for the first and second offenses, which shall be at the discretion of

the court, and no sentence or fine shall be suspended for any cause or reason whatsoever, nor shall any diminution of sentence be

granted or allowed for good behavior or otherwise.

DIVISION 5.  BOATS AND BOATING

Sec. 78-386. Permit Required; Fee; Duration; Waiver of fee.

(a) Permits shall be required for all boats operated on Cross Lake and C. Bickham Dickson Lake, and the owner of each boat shall

make application for such permit with the superintendent of the Shreveport Police Department Marine Patrol Division. Such

permit shall be issued upon the payment of the fee set forth in this section, and the showing of a valid state boat registration

certificate, when required.

(b) Permits for all boats shall be issued for a fee of $20.00. This permit shall be displayed on the boat in the same line and

immediately following the state boat registration number.

(c) Commercial or rental boat permits shall be issued for a fee of $75.00 annually regardless of the number of boats. The permit

shall be kept by the owner of the business and each boat provided for rental shall be identified with the business name of the

permit holder.

(d) Boat dealer shall be issued permits for demonstrators, regardless of number, upon application to the Superintendent of the

Marine Patrol Division and payment of the $75.00 annual permit fee. Permits shall be displayed on or carried in such

demonstrators and shall be shown to proper enforcement officers upon request.

(e) All permits issued under this section shall expire on the last day of the twelfth month following the date of issuance.

(f) Notwithstanding the provisions of this section, the Chief Administrative Officer of the City of Shreveport reserves the right to waive

such fee or fees for special events including, but not limited to, regattas, races and the like.

(g) The term “boats’’ as used in this section shall include surf-sailing boats or boards.

Sec. 78-387. Operation of Watercraft.

The operation of watercraft on Cross Lake shall be in accordance with R.S. 34:850.1 through 34:851.5, and shall be enforceable by

the issuance of citations and by prosecution in the City Court.

Sec. 78-388. Hours of Operation of Watercraft.

(a) It shall be unlawful for any person to occupy or operate any boat or watercraft, except a houseboat, on Cross Lake during the

period from 1:00 a.m. to daylight (30 minutes before sunrise). During such period all boats shall be removed from the lake or

properly moored.

(b) The occupation or operation of houseboats is prohibited on Cross Lake between the hours of 12:00 midnight and 6:00 a.m.

(c) The provisions of this section shall not apply to the following:

(1) City-owned or city-operated boats.

(2) Contractors conducting authorized commercial fishing and/or turtle trapping or netting activities on Cross Lake under

agreement with the City of Shreveport.

(3) Boats which meet the following requirements:

a. The boat must have toilet facilities and sleeping facilities manufactured in accordance with federal regulations for

recreational vessels prescribed under 46 USCA 4307 or other applicable law.

b. The boat must be tied to a dock or other permanent structure located on land, not including an island, with the

permission of the owner of the structure.

c. The boat shall be subject to inspection for compliance with the provisions of this section by the Chief of Police or his

designee and the Director of Water and Sewerage or his designee.

d. All overnight occupants of the boat shall execute a hold harmless agreement with the city, in a form approved by the

City Attorney and shall file it with the Cross Lake Superintendent.

e. The owner of the board shall obtain an overnight boat permit, in addition to the permit required under section 78-386.

He shall make application to the Cross Lake Superintendent, who shall issue the permit if he finds the requirements of

this subsection (c)(3) are met and upon payment of the fee set forth herein.

f. The fee for an overnight boat permit shall be $15.00. All permits issued under this section shall expire on the last day of

the 12th month following the date of issuance.

Sec. 78-389. Prohibited Operation.

(a) The operation of any motorboat is prohibited on Cross Lake and any area inundated by Cross Lake when it is above contour

elevation 172, when the operation of such motorboat causes or may cause inundations of dwellings, camps, business

establishments or similar structures.

(b) The provisions of this section shall not apply to law enforcement officers, members of the National Guard, commercial

fishermen and members of a rescue or disaster relief organization or group when any of such people are in the exercise of their

duties. In addition, this section shall not apply to a person who resides or owns property in or adjacent to the flooded area, or his

representatives, while engaged in caring for his life, family, or property, or the lives, families, or properties of his neighbors, or to

a company which operates in or adjacent to the flooded area, or its representatives, while engaged in caring for the lives of its

employees or its property, provided entry is not denied by a law enforcement officer or other person authorized to be within the

area in the exercise of his duties.

Sec. 78-390. Rules of the Road for Inland Bodies of Water to be Observed.

Boat operators using the waters of Cross Lake shall know, understand and observe the “Rules of the Road” for inland bodies of

water. Such rules shall be issued to the boat owner upon request with his boat permit.

Sec. 78-391. Regulation of Vessels Equipped with Sanitation Facilities; Houseboats.

(a) Any vessel equipped with personal sanitation facilities or other toilet facilities shall not discharge such facilities into Cross Lake.

Such sanitation facilities shall be inspected for integrity as frequently as deemed necessary by the Cross Lake Superintendent.

(b) Any person convicted of violating subsection (a) of this section shall, in addition to the penalties provided in this article, be subject

to having his boat permit revoked.

(c) The occupation of houseboats is prohibited on the waters of Cross Lake between the hours of 12:00 midnight and 6:00 a.m.

DIVISION 6.  FISHING

Sec. 78-401. General Regulations.

Fishing on Cross Lake shall be conducted subject to the regulations governing the lake relative to sanitation and pollution.

Otherwise, fishing shall be subject to all effective laws of the state, except where considered in conflict with the sanitation and

pollution regulations governing Cross Lake and its watershed.

Sec. 78-402. Night Fishing Prohibited Near Boathouses and Piers.

Night fishing is prohibited within 100 feet of boathouses and piers at Cross Lake.

Sec. 78-403. Use of Nets, Traps and Other Similar Devices.

The taking of fish, turtles or other wildlife from Cross Lake or C. Bickham Dickson Lake by the use of nets of any kind, traps, wire

baskets, yoyos, set lines, or trotlines is hereby prohibited.

Sec. 78-404. Commercial Fishing.

Commercial fishing on Cross Lake is prohibited, except pursuant to a valid contract, approved by the City Council, between the City

of Shreveport and the person desiring to engage in commercial fishing activities. Such contract may provide for exemptions from the

prohibitions contained in subsection (a) of this section. Such commercial fishing activities shall at all times be conducted in

compliance with applicable state and federal laws. All nets, traps or other devices used in commercial fishing activities conducted

under authority of this subsection shall be approved by the Cross Lake Superintendent.

DIVISION 7.  WATERSKIING, SWIMMING AND SURF-SAILING

Sec. 78-416. Generally; Parasailing Prohibited.

Waterskiing, swimming and surf-sailing shall be permitted on the waters of Cross Lake subject to the regulations prescribed in this

division and other applicable provisions of this article. Parasailing is not permitted on the waters of Cross Lake, except in operations

pursuant to contract approved by the city council.

Sec. 78-417. When and Where Permitted.

Waterskiing, swimming, and surf-sailing shall be permitted on Cross Lake in accordance with the following provisions:

(1) Such activities are permitted only between the hours of sunrise and sunset daily.

(2) Such activities are prohibited in areas so designated and marked by the Shreveport Police Department Marine Patrol

Division.

(3) Such activities are prohibited during migratory bird hunting season.

(4) Swimming is permitted only within 30 feet of a pier, boat, or boathouse.

(5) Swimming adjacent to city park areas is prohibited except where designated as permitted by the parks and recreation

department.

Sec. 78-418. Skibelt or Lifejacket Required.

A person being towed, skiing, riding or driving a personal water craft shall at all times wear a suitable United States Coast Guard

approved lifejacket.

Sec. 78-419 Waterskiing on Cross Lake Prohibited While Intoxicated or Under the Influence of Drugs.

No person shall waterski on Cross Lake while intoxicated or under the influence of intoxicants, narcotics or barbiturates.

Sec. 78-420. Operator and Observer Required on Towboat.

When participating in waterskiing on Cross Lake, a towboat pulling skiers, tubers, or other persons operating any boat or personal

watercraft as defined herein shall have at least two responsible persons on board at all times, one serving as the boat operator, the

other as an observer. For the purposes of this section any observer on any boat or personal watercraft shall be at least 12 years of

age.

Sec. 78-421. Responsibilities of Boat Operator.

A boat operator towing a skier on Cross Lake shall be responsible at all times for the safe operation of both the boat and the towed

skier. The boat shall be operated at all times in a safe and responsible manner, constantly mindful of the life and property of others.

Sec. 78-422. Swimming Attire Required.

All swimmers shall wear swimming attire.

Sec. 78-423. No Fee  for Swimming.

No person other than a governmental entity or a private party operating pursuant to a grant of authority from such entity shall charge

a monetary fee for access to or use of Cross Lake for swimming.

Sec. 78-424. Personal Watercraft.

(a) Definitions. For the purposes of this section, certain words and phrases used herein are defined as follows:

Personal watercraft means a vessel which uses an inboard motor powering a water jet pump as its primary source of motive

power and which is designed to be operated by a person sitting, standing, or kneeling on a vessel rather than the conventional

manner of sitting or standing inside the vessel.

(b) Rules and regulations.

(1) All persons operating personal watercraft shall observe the same rules and regulations as boats towing skiers, tubers, etc.

(2) Anyone operating a personal watercraft equipped by the manufacturer with a lanyard type engine cutoff switch shall attach

such lanyard to their person, clothing or personal flotation devise as appropriate for the specific vessel.

(3) No one under the age of 13 shall be allowed to operate a personal watercraft.

(4) No gasoline powered engines shall be allowed at any time upon the waters of C. Bickham Dickson Lake.
